Project GREEN Terms of Service

1. Introduction

Welcome to Project GREEN (“Project GREEN”, “we”, “us”, or “our”). We are a Michigan-based nonprofit organization dedicated to providing personal finance education and resources. These Terms of Service (“Terms”) govern your access to and use of our website, services, and any related content (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Services.   

2. Description of Services

Project GREEN provides a variety of personal finance resources, including educational materials, workshops, counseling, and online tools. These Services are designed to help individuals improve their financial literacy and make informed financial decisions.

3. Eligibility

Our Services are available to individuals who are residents of Michigan. By using the Services, you represent and warrant that you are a resident of Michigan and are of legal age to form a binding contract.

4. User Accounts

Some of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and you are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.   

5. User Conduct

You agree to use the Services only for lawful purposes and in a manner that does not violate these Terms or any applicable laws or regulations. You specifically agree not to:

  • Use the Services in any way that could harm, disable, overburden, or impair the Services or interfere with any other party’s use of the Services.
  • Use any robot, spider, or other automatic device or process to access the Services for any purpose.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Collect or store personal data about other users without their consent.
  • Engage in any conduct that is harmful, offensive, or discriminatory.

6. Intellectual Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Project GREEN, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.   

7. Disclaimer of Warranties

The Services are provided “as is” and without warranties of any kind, express or implied. Project GREEN disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Project GREEN does not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful components.   

8. Limitation of Liability

In no event shall Project GREEN be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if Project GREEN has been advised of the possibility of such damages.   

9. Indemnification

You agree to indemnify and hold harmless Project GREEN and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.   

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.   

11. Termination

Project GREEN may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately.   

12. Changes to Terms

Project GREEN reserves the right to modify these Terms at any time in its sole discretion. If we make material changes to these Terms, we will post the updated Terms on our website and update the “Last Updated” date at the top of this page. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.   

13. Entire Agreement

These Terms constitute the entire agreement between you and Project GREEN relating to the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Project GREEN with respect to the Services.
